Florida says a milestone inspection with no repair recommendations cannot pause condo reserves

Completing a milestone inspection does not by itself let a Florida condominium pause required structural reserve funding, the state's condo division has ruled.
The agency disposition addressed a milestone report for La Bonne Vie Condominium Apartments that contained no recommended required repairs. The division said section 718.112(2)(f)2.e. gives an association no authority to pause or reduce structural integrity reserve funding on that basis.
The statute permits a pause for no more than two consecutive annual budgets only when four conditions are met. The budget must be adopted by December 31, 2028, the milestone inspection must fall within the previous two calendar years, a majority of all voting interests must approve, and the pause must fund repairs the inspection recommended.
A no-repair report does not switch reserve contributions off.
