Plan approval criteria

Two proposals would take away a district manager's power to add measures to a coal mine's roof control and ventilation plans, and MSHA has reopened the record on both

The change in each proposal is a deletion.

One would strike the provision in 30 CFR 75.222(a) that lets a district manager require additional measures to be written into an underground coal mine's roof control plan, and the other would strike the authority in 30 CFR 75.371 that lets a district manager require additional provisions in a ventilation plan. Both were published on 1 July 2025, at 90 FR 28432 and 90 FR 28443. Neither has been finalised.

On Friday morning the Mine Safety and Health Administration filed notices reopening the rulemaking record on both and scheduling a virtual public hearing on each. The stated reason is a public request. Comment on the two proposals ran for 30 days in July 2025, was extended by another 30, and closed on 2 September that year, and somebody asked for a hearing inside that window. The agency is now giving one.

The dates

Roof control is heard on 15 September 2026, ventilation on 16 September, both starting at 9 a.m. Eastern and both running until the last speaker has finished. Anyone who wants to speak should register by 11:59 p.m. Eastern on 11 September, and MSHA says those who do not register in advance will be called after those who did. Written comments on either proposal close at 11:59 p.m. Eastern on 30 September 2026. Anything already filed stays in the record and does not need filing again.

Neither hearing is a trial. MSHA writes that the proceedings will be informal, that the formal rules of evidence will not apply, and that there will be no cross examination. A verbatim transcript of each goes into the rulemaking record and onto regulations.gov.

Neither notice explains why the two provisions were proposed for deletion in the first place, and neither is the document where that reasoning lives. What each puts at issue is narrow and identical: whether a district manager can require anything an operator has not already written into the plan.

Neither notice states a rationale for the underlying proposals; the reason given for the reopening is, verbatim, 'In response to a public request.'
