White House renews the $100,000 H-1B condition and orders sponsor layoff checks
The White House has renewed for 12 months a restriction on certain H-1B workers entering the United States unless an employer's petition includes a $100,000 payment.
The proclamation takes effect September 21 and runs until September 21, 2027. A separate executive order tells agencies to consider whether a sponsor made layoffs in the prior year or plans layoffs affecting similarly situated United States workers.
The Labor Department must begin reviewing earlier labor condition application data within 30 days.
The legal position is unsettled. In July, the First Circuit refused to pause a district court judgment that vacated the agency policy implementing the earlier payment requirement. The new documents do not address that ruling.
