FTC and USDA ask farmers about equipment sales, service and retaliation

The agencies have not reached a conclusion.

The joint FTC and USDA inquiry asks farmers, independent repair providers and equipment dealers for evidence about the agricultural equipment market. Its 13 questions cover territorial sales and service limits, outside-territory penalties, dealer consolidation, access to repairs and parts, and threatened or actual retaliation.

The document asks respondents to identify business models or contract terms and provide examples or pricing data. It defines retaliation for the inquiry to include blacklisting, denial of equipment or parts, worse commercial terms or other penalties.

Comments are due December 7 at 11:59 p.m. Eastern under docket FTC-2026-1585. Public submissions go to Regulations.gov and will generally be posted online. The inquiry makes no finding against any manufacturer or dealer.
