Three South Atlantic species shut to commercial fishing on the same Monday, and the year's whole allowance for the three of them comes to 266,246 pounds

Two hundred and sixty six thousand pounds. That is the whole commercial year for three South Atlantic species added together, and all three of them are now spent.

The National Marine Fisheries Service filed three closure notices at a quarter past four on Wednesday afternoon, each one a temporary rule shutting a commercial sector from 24 August through 31 December. Red snapper carries an annual catch limit of 102,951 pounds. Blueline tilefish carries 117,148 pounds. The scamp and yellowmouth grouper complex, which did not exist as a management unit until 6 July, carries 46,147 pounds.

None of the three is a decision in the ordinary sense. Each one is an accountability measure that fires automatically once the agency projects that landings will reach the limit, and in all three cases the projected date is the day the closure starts.

What the rules say happens next

The three read almost identically, and the differences are where the money is. During each closure the sale or purchase of the species is prohibited outright, and harvest or possession aboard a vessel with a federal commercial or charter permit falls to the recreational bag and possession limits, without regard to whether the fish came out of state or federal water.

Red snapper carries one extra line. An operator holding red snapper on a permitted vessel must have landed it and bartered, traded or sold it before 24 August. Landing it is not enough on its own.

The reopening dates are not symmetrical either. All three closures run to the end of the fishing year on 31 December, and for red snapper the notice points to a further wait: unless the agency specifies otherwise, the 2027 commercial season begins on the second Monday in July.

Filed without notice or comment, and the reason given

Each notice waives prior notice and comment under 5 U.S.C. 553(b)(B), and each waives the 30 day delay in effectiveness as well. The reasoning offered is the same in all three. The rule that set up the accountability measure has already been through comment, so all that is left is to tell the public that the trigger has been pulled, and the capacity of the fleet is such that a delay could put the harvest well past the limit before the paperwork clears.

One small thing survives in the scamp notice that a reader of the public inspection version can see and a reader of the published version will not. The sentence giving the projection date still carries its drafting instruction, in square brackets, telling the compositor to insert the date five days after filing. The operative sentence two lines later gives the date plainly as 24 August.
