IRS says Tribal Tax Credits do not exist and may bring penalties
Federal tax credits marketed as Tribal Tax Credits, Native American Tax Credits or Sovereign Tribal Tax Credits do not exist, the IRS said Friday. Promoters claim buyers can reduce federal tax or generate refunds.
IR-2026-112 says neither tribal ownership, interagency agreements, executive orders nor section 45D creates the advertised credit. Federal transfer rules apply only to specified clean-energy credits.
Return acceptance is not approval. The IRS says filers remain responsible for their returns and may owe tax, penalties and interest. Suspected promotions can be reported on Form 14242.
