Attorneys for Evolve Construction and related defendants deny Florida's allegations that the Naples-based contractor used unfair or deceptive practices in hurricane-repair work, according to a statement reported by WINK News.
WINK reports that the legal team for Evolve Construction LLC, Evolve Construction & Restoration Inc. and two executives said the clients take the allegations seriously but deny that they deliberately exploited hurricane victims. The attorneys said they intend to present evidence and seek a resolution based on the facts and law.
The Florida Attorney General's complaint was filed September 25 in Lee County Circuit Court. It alleges that the defendants violated the Florida Deceptive and Unfair Trade Practices Act while soliciting and performing storm-damage mitigation and roof work after Hurricane Ian.
The complaint says the Attorney General received 80 consumer complaints from February 2023 through the filing date. It alleges that some customers paid money or transferred insurance proceeds without receiving all contracted work. That is the state's account, and the number does not establish that every complaint was substantiated.
Florida is asking the court for injunctions, consumer restitution, disgorgement, attorney fees and civil penalties. Those are requested remedies, not an award. The complaint contains allegations that have not been adjudicated, and the companies have not been found liable.
