Commerce names 19 jurisdictions eligible for zero tariffs on specialty drugs

Commerce has named 19 jurisdictions whose qualifying specialty medicines can receive a zero Section 232 tariff, according to a notice filed late Monday.

The list includes the European Union, India, Japan, South Korea, Taiwan and the United Kingdom. It also includes 13 other jurisdictions.

Eligible products include medicines used only for designated orphan indications, nuclear medicines, plasma-derived therapies, fertility drugs, cell and gene therapies, antibody drug conjugates, specified medical countermeasures and animal-health products. Companies can also request a zero rate for a product that meets an urgent US health need.

The underlying 100 percent tariff starts September 29 for companies outside the proclamation's earlier annex. Generic drugs are currently outside the pharmaceutical tariff program.
