Two 1099s, four thresholds and one deadline trap

The 2026 forms split services from rents, royalties and other payments, but that familiar rule is only the start. The payment method, recipient, box and filing medium can change whether a form is required and when it is due.

The form name is the easy part.

The IRS instructions for 2026 give Form 1099-NEC one principal job: report compensation for services performed by somebody who is not an employee. Form 1099-MISC carries rents, royalties, prizes not awarded for services, medical payments, attorney gross proceeds and a collection of narrower payments that do not belong in the service box.

That division is clean enough to fit on a card. The filing system around it is not. The general reporting threshold rose from $600 to $2,000 for payments made after 31 December 2025, but royalties remain at $10, gross proceeds paid to an attorney remain at $600, and consumer-product direct sales use a $5,000 test. The same direct-sale transaction can appear on either form, with a different IRS deadline depending on the box selected.

Payment method can displace both forms. Recipient type can override the usual corporation exception. Backup withholding can create a filing below the ordinary threshold. Ten information returns across several form families can turn a paper filer into an electronic filer.

The practical distinction is therefore larger than NEC for contractors and MISC for everything else. The correct form follows the payment, the capacity in which it was made, the payee, and sometimes the rail over which the money moved.

What is the difference between 1099-NEC and 1099-MISC?

Form 1099-NEC reports compensation for nonemployee services performed for a trade or business. Form 1099-MISC reports specified other payments, including rents, royalties, prizes not tied to services, medical payments and attorney gross proceeds. The underlying transaction determines the form. The payee's job title does not.

The four-part test in the specific IRS instructions puts nonemployee compensation in Form 1099-NEC box 1a when the payer made the payment to someone who was not an employee, paid for services in the course of a trade or business, paid an individual, partnership, estate or certain corporation, and reached the applicable annual threshold.

Parts and materials do not automatically turn a service invoice into merchandise. The instructions include the total payment when supplying the parts was incidental to the service. An auto repair contract that states labor and parts separately is the IRS example. If the parts were incidental to repairing the vehicle, the whole contract payment is nonemployee compensation.

Form 1099-MISC starts where that service relationship ends. Office rent goes in box 1. Royalties go in box 2. Prizes and awards that are not for services go in box 3. Medical and health care payments go in box 6, crop insurance proceeds in box 9, and gross proceeds paid to an attorney in box 10.

The dividing line can run through two payments to the same person. A prize for work performed belongs with compensation on Form 1099-NEC. A sweepstakes prize that did not involve services belongs in Form 1099-MISC box 3. The form describes why the money was paid, not merely who received it.

That point matters for tax characterization too. The instructions say amounts paid to individuals in the NEC service box are generally subject to self-employment tax. They direct payments that are not subject to that tax to Form 1099-MISC box 3. The reporting form reflects the character of the payment. It does not create that character by itself.

What is the 1099 reporting threshold for payments made in 2026?

The general threshold is $2,000 for payments made in 2026, including nonemployee services, rents and several Form 1099-MISC categories. It is not universal. Royalties and substitute payments use $10, two attorney and fish categories remain at $600, and direct sales use $5,000. Backup withholding removes the floor entirely.

Congress changed the base rule in section 70433 of Public Law 119-21. The law replaced $600 with $2,000 in section 6041(a), tied remuneration for services under section 6041A to the same amount, and made the amendments effective for payments after 31 December 2025. It also added inflation adjustment for calendar years after 2026, rounded to the nearest $100.

The old $600 answer is therefore wrong for an ordinary 2026 service payment. It remains correct in two places on Form 1099-MISC: gross proceeds paid to an attorney in box 10 and cash purchases of fish for resale in box 11. Attorneys' fees for legal services, by contrast, follow the new $2,000 service threshold and go in Form 1099-NEC box 1a.

The full 2026 threshold map is less tidy than the headline:

The threshold is an information-reporting floor. It is not an income exclusion for the recipient. The IRS may also accept voluntary reporting below the minimum. Publication 1099 says filers may submit returns for smaller payments for economy or convenience, even when a return is not required.

When are 1099-NEC and 1099-MISC due?

Form 1099-NEC is due to both the recipient and the IRS by January 31. Form 1099-MISC generally reaches the recipient by January 31, but the IRS deadline is February 28 on paper or March 31 electronically. A weekend or legal holiday moves a due date to the next business day.

The difference is built into section 6071(c), which gives nonemployee compensation its January deadline. Paper and electronic NEC returns share it. The general automatic 30-day filing extension available through Form 8809 does not apply to Form 1099-NEC. The filer must meet one of the conditions stated on Form 8809 for a nonautomatic extension.

MISC has more room on the IRS side. Its ordinary due date is February 28 for paper returns and March 31 for electronic returns. The recipient usually gets a statement by January 31, so the payer's copy can be due weeks before the IRS copy.

Two MISC boxes receive extra recipient time. Publication 1099 sets a February 15 statement deadline for substitute payments reported in box 8 and gross attorney proceeds in box 10. This exception changes the recipient date, not the ordinary IRS filing dates.

Direct sales expose the consequence of choosing between two legally permitted boxes. A payer may report $5,000 or more of consumer-product sales for resale in Form 1099-NEC box 2 or Form 1099-MISC box 7. The instructions warn that selecting Form 1099-NEC brings the January 31 IRS deadline with it. The MISC box carries the later MISC filing calendar.

Extensions for recipient statements run on a separate track. Publication 1099 directs filers to Form 15397, filed online or by fax by the statement due date. If approved, the extension generally allows no more than 30 extra days. A filing extension does not silently extend recipient delivery.

Do credit card and payment app transactions go on either form?

Payments made through a credit card, payment card or covered third-party network are reported by the payment settlement entity on Form 1099-K. The business payer does not report the same transaction on Form 1099-NEC or Form 1099-MISC. Payment method can therefore override the form suggested by the expense itself.

The 2026 instructions state the exclusion directly. Payment card transactions and certain third-party network transactions fall under section 6050W and are not subject to reporting on NEC or MISC. The settlement entity has the information-return obligation.

This is a payer-side rule about duplicate reporting. A contractor's service still has the economic character of compensation. The reporting path changes because a card network or qualifying payment platform sits between the business and the recipient.

The distinction also explains why comparing the $2,000 NEC threshold with the Form 1099-K threshold can mislead. They govern different filers and different payment rails. None of those tests converts a card-funded contractor invoice back into the business payer's NEC return.

Checks, cash and direct bank payments do not receive that payment-settlement exception merely because an app or bank interface was used to initiate them. The legal question is whether the transaction is a payment card or third-party network transaction within section 6050W, not whether the payment appeared on a screen.

Do corporations and LLCs receive Forms 1099-NEC or 1099-MISC?

Payments to corporations, including LLCs taxed as C or S corporations, are generally exempt from NEC and MISC reporting. The exception is broad but incomplete. Legal services, attorney gross proceeds, medical and health care payments, substitute payments and cash fish purchases remain reportable to corporations when their separate rules are met.

An LLC label alone does not answer the question because an LLC can be disregarded, taxed as a partnership, or treated as a corporation. The IRS instructions for the requester of Form W-9 use the federal tax classification and exemption code to identify the payee for information reporting.

Legal services cut through the corporation exception in both directions. Attorneys' fees for services go in NEC box 1a. Gross proceeds paid to an attorney in connection with legal services, such as settlement proceeds that are not the attorney's own fee, go in MISC box 10. The instructions define attorney to include a law firm or other provider of legal services and apply the rules whether or not the firm is incorporated.

Medical and health care payments to corporations also remain reportable on MISC. The recipient is the corporation providing the services, not the individual physician. Tax-exempt hospitals and facilities owned and operated by government are among the stated exceptions.

Payments to partnerships are generally reportable once the applicable payment rule and threshold are met. That contrast, corporation usually exempt and partnership usually covered, is one reason the payee record matters as much as the invoice description.

When must a small business file 1099s electronically?

A filer required to submit 10 or more covered information returns during a calendar year must file electronically. The count is aggregated across form types, including Forms W-2 and the 1099 series. It is not 10 NEC forms plus 10 MISC forms. Ten covered returns in total cross the threshold.

The live text of 26 CFR 301.6011-2 supplies the rule. It counts the covered returns required during the calendar year in the aggregate. A filer with four Forms 1099-NEC, three Forms 1099-MISC and three Forms W-2 has 10 covered returns for this test, even though no single form type reaches 10.

Corrections do not count toward deciding whether the threshold was reached. They follow the original filing method. If an original return had to be filed electronically, the corresponding correction must also be electronic. If an original was permitted on paper and filed on paper, its correction is filed on paper.

For 2026 returns, Publication 1099 identifies the Information Returns Intake System, or IRIS, as the IRS electronic channel. The taxpayer portal permits manual entry or CSV upload and accepts up to 100 forms in one submission. Application-to-Application filing uses XML and separate software for larger volumes.

A hardship waiver is possible through Form 8508, but it must be approved. The publication states that a required electronic filer who files paper without an approved waiver may face the failure-to-file penalty for returns above the 10-return threshold.

What happens when backup withholding applies?

Backup withholding is 24 percent and can require a Form 1099 even when the payment is below its ordinary reporting threshold. It can apply when a payee fails to furnish a taxpayer identification number, supplies an incorrect one, or meets another statutory condition. The withheld amount is also reported on Form 945.

The $2,000 floor does not make a missing taxpayer identification number harmless. Both forms' instructions require a return for a person from whom federal income tax was withheld under the backup-withholding rules, regardless of the payment amount. Box 4 carries the federal tax withheld on NEC and MISC.

Publication 1099's backup-withholding section also closes a common timing escape. A payee who has applied for a taxpayer identification number may sometimes use an awaiting-TIN certificate with a 60-day period, but that grace applies only to interest, dividends and certain readily tradable instruments. Nonemployee compensation remains subject to backup withholding while the number is pending.

The filing consequences are separate. Backup withholding is reported on the information return even if the payment amount is below the normal threshold. It is also deposited and reported through Form 945 under its own timetable. One transaction can therefore produce a below-threshold NEC or MISC, a recipient statement, and a withholding return.

What changed on the 2026 forms besides the threshold?

The 2026 revisions add fields for cash tips, Treasury tipped occupation codes and qualified overtime compensation. Form 1099-NEC also moves excess golden parachute payments into a new box 3. These amounts are subdivisions or reclassifications of other reported compensation, not new general thresholds for every payer.

On Form 1099-NEC, box 1b reports cash tips included in the nonemployee compensation already reported in box 1a. Box 1c takes up to two Treasury tipped occupation codes, with code 000 required as one of them if any tips came from a nonqualifying occupation. Box 1d reports qualified overtime compensation already included in box 1a.

Form 1099-MISC places the parallel fields at boxes 13a, 13b and 14, tied to amounts included in box 3. The overtime field contains only the premium portion required by section 7 of the Fair Labor Standards Act. For time-and-a-half pay, the instructions identify the additional half as the reportable qualified overtime amount.

Excess golden parachute payments moved from MISC to NEC box 3. The regular compensation, including any golden parachute payment, remains in NEC box 1a for an independent contractor. Box 3 then identifies the excess over the base amount under the section 280G rules.

These fields make prior-year forms unusable for 2026 reporting. Publication 1099 says current-year information must use the current-year form, while the specific instructions say the December 2026 revisions continue for later years until the IRS supersedes them.

What are the answers to the common filing questions?

The short answers follow the transaction. Services generally point to NEC, while rents, royalties and specified nonservice payments point to MISC. The 2026 general threshold is $2,000, but exceptions remain. Payment cards point to 1099-K, 10 total information returns trigger e-filing, and backup withholding can require a form below the floor.

Is a 1099-NEC required for a $1,500 contractor payment made in 2026?

Not under the ordinary dollar test. The general threshold for payments made in 2026 is $2,000. A return can still be required below that amount when backup withholding occurred, and the threshold does not determine whether the recipient must report taxable income.

Does Form 1099-MISC still use a $600 threshold?

Only for specified categories. Gross proceeds paid to an attorney and cash purchases of fish for resale retain $600 thresholds on the 2026 form. Rents, many prizes, medical payments and several other categories now use $2,000. Royalties and substitute payments use $10.

Can direct sales be reported on either form?

Yes. Consumer-product sales totaling $5,000 or more for resale may be reported in Form 1099-NEC box 2 or Form 1099-MISC box 7. The payer reports them on one form, not both. Using NEC also brings the January 31 IRS filing date.

Does receiving no form make a payment nontaxable?

No. An information-return threshold governs the payer's filing obligation. It does not decide whether the payment is income to the recipient. The tax treatment follows the underlying transaction, even when no NEC or MISC is issued.

Can a filer print Copy A from the IRS website and mail it?

Generally, no. The red Copy A forms are machine read, and Publication 1099 says web-printed Copies A of Forms 1099 are not acceptable for paper filing. A filer permitted to use paper needs an official scannable form or a substitute meeting the IRS specifications.
