Ariel Gonzalez Rodriguez, 25, is accused in the death of Jason Sheffield in the 2700 block of 8th Avenue Southeast, east of Naples. WINK News reported the arrest and the charge on July 29, and attributed the account that follows to the arrest affidavit.

According to that affidavit, as reported by WINK, Gonzalez Rodriguez told investigators he heard a noise near his chicken coop at around midnight and fired warning shots with a .22 calibre rifle. He said he later returned with a .30-06 rifle, believing an animal was threatening his property, and fired toward the noise.

The affidavit states that he called 911 at about 8:21 a.m. on March 27 and told dispatchers he believed he had accidentally shot and killed his neighbour. He said he had walked over to the adjoining property, searched the area, and found Sheffield lying face down. He remained on the phone until deputies arrived.

Investigators said Gonzalez Rodriguez told them he had no dispute with Sheffield, and that the two men had spent the evening before the shooting together, grilling one of his chickens in Sheffield's back garden.

The affidavit records the conclusion investigators reached: that he fired a high powered rifle in a residential area toward a target he had not identified, and that this amounted to what the document calls "culpable negligence". Culpable negligence is the standard Florida law requires for a manslaughter charge, and it is the element the case turns on.

The District 20 Medical Examiner ruled Sheffield's death a homicide caused by a gunshot wound to the back.

None of this is a finding of guilt. The charge is an accusation made by the sheriff's office and it has not been tested in court. The case is pending in Collier County. No plea has been reported.
