Immokalee Sand Mine seeks 41-acre expansion under state permit notice

In short

Florida's Department of Environmental Protection has announced its intent to permit an approximately 41-acre expansion of Stewart Materials' Immokalee Sand Mine. The October 2 notice identifies 2.3 acres of new wetland impacts and 2.34 acres of other surface-water impacts. It describes a hearing process before the action becomes final.

An approximately 41-acre expansion of Stewart Materials' Immokalee Sand Mine would affect 2.3 acres of wetlands and 2.34 acres of other surface waters, according to a Florida Department of Environmental Protection notice published October 2. WGCU's Tom Bayles reported on the proposal October 13.

What the permit notice establishes

The Collier County project is the subject of an intent-to-issue notice, file MMR_228414-009. That document describes proposed impacts, rather than a finding that those impacts have occurred.

DEP says a timely, sufficient hearing petition would keep the action from becoming final until a further agency order. The notice sets out different 21-day filing rules depending on publication, receipt of written notice and the recipient's status. It does not establish one deadline for every reader.

The complete notice includes the filing requirements and the route to the agency's application records.
