EU top court upholds Google's €4.1bn Android fine, ending the appeal

The Court of Justice of the European Union dismissed the appeal brought by Google and Alphabet in Case C-738/22 P on July 2. That fixes the fine at €4,125,000,000, with Alphabet jointly and severally liable for €1,520,605,895. The European Commission decided in 2018 that Google had abused a dominant position through Android pre-installation agreements and licensing conditions, and set the penalty at €4,342,865,000. The General Court annulled the part covering revenue share agreements in 2022 and cut the fine to its current level. The Court of Justice held that the General Court was entitled to weigh the economic context in full without running a counterfactual analysis in every case. No further appeal exists.
