The Florida condo and HOA desk

More than a quarter of Florida's housing sits inside a condominium or homeowners association, and since the Surfside collapse in 2021 the state has rebuilt the rules those buildings live under. The new framework arrives as a series of deadlines, studies, and funding mandates, and each one lands on unit owners as a number: an assessment, a reserve contribution, a higher monthly fee, or a change in what a buyer will pay for the unit. That collision of safety law and household money is this desk's beat.

The deadlines that matter

These are the load-bearing dates in current Florida law, from the statutes themselves, linked so you can read the exact text.

Milestone structural inspections. Under section 553.899, Florida Statutes, every condominium or cooperative building three habitable stories or taller must have a structural inspection by an architect or engineer by December 31 of the year it turns 30, and every 10 years after that. Local governments may require it at 25 years where conditions such as salt water proximity warrant. Buildings that were already 30 before July 2022 were due by the end of 2024, and buildings turning 30 between mid 2022 and the end of 2024 were due by December 31, 2025. A phase one visual inspection that finds substantial structural deterioration triggers a mandatory phase two, which can include testing.

Structural integrity reserve studies. Under section 718.112, Florida Statutes, associations with buildings three stories or taller must complete a structural integrity reserve study covering the roof, structure, fire protection, plumbing, electrical, waterproofing and exterior painting, windows and exterior doors, and any other item whose replacement or deferred maintenance exceeds a $25,000 inflation-adjusted threshold. Owner-controlled associations that existed in mid 2022 must complete the first study by December 31, 2025, or December 31, 2026 where it is combined with a milestone inspection, and repeat it at least every 10 years.

The end of reserve waivers. For budgets adopted after December 31, 2024, the same statute bars unit owners from voting to fund no reserves, or reduced reserves, for the items a structural integrity reserve study covers. The decades-old habit of keeping monthly fees low by waiving reserves is over, and the catch-up is arriving in budgets now.

If you are buying into a Florida condo

Before contracting on a resale unit in a building three stories or taller, ask for three documents: the most recent milestone inspection report, the structural integrity reserve study, and the current budget showing how the reserves it calls for are actually being funded. A building that cannot produce them is telling you something. The gap between "the fee is low" and "the reserves are funded" is where five-figure assessments live.
